D. We shall always aim to remedy your complain immediately. Where such remedy is not available immediately, we shall acknowledge receipt of your complaint in writing within 5 working days of the complaint being made. Where your complaint concerns services provided by us through the Site, we shall aim to give you our response within 10 days after the complaint has been received by us. Where the complaint relates to exceptional circumstances which are beyond our control, such circumstances include but are not limited to: internet service provider failure; power failure; acts of God; pandemic; epidemic; fire; flood; droughts; storms; civil unrest; collapse of buildings; earthquakes; explosion; accidents; acts of war or terrorism; or any law or actions taken by government or public authorities or any other event that is beyond our control we shall aim to respond to your complaint within a maximum of 30 working days of the complaint being made. If your complaint does not relate to any service provided by us through the Site, we shall aim to provide a response to your complaint within 8 weeks of the complaint being made and where we shall take longer than 8 weeks, we shall Inform you of this.

 

E. If you and we cannot resolve a dispute using our complaint handling procedure, we will:

II. consider the need for Alternative Dispute Resolution and, if considered necessary, provide you with information about any alternative dispute resolution provider we deem appropriate to deal with your complaint.

F. If you want to take court proceedings, the relevant courts of the United Kingdom will have exclusive jurisdiction in relation to these Terms.

Research Terms & Conditions of Use

When you register to receive our research documents, you are making an agreement with our sister company Consortium Maritime Trading Ltd (CMTL) 

1.1 This Policy sets out the Terms under which Consortium Maritime Trading Ltd provide Weekly Reports on a chargeable Subscription basis.

1.2 Subscribers have access to Weekly Reports and other data produced by CMTL. Weekly Reports are compiled by CMTL using market intelligence and other available information.

1.2.1 Access to Weekly and Subscription rates are via the CMTL website https://www.consortiummaritime.co.uk

1.3 Any and all Copyright and Intellectual Property Rights (“IPR”) in and to the Weekly Reports are the property of CMTL. This agreement does not constitute an assignment of any copyright or any other IPR whatsoever in respect of Weekly Reports but constitutes only a limited, non-distributable, non-transferable, non-sublicensable and non-exclusive access to Weekly Reports. The access granted shall continue in force for the duration of your continued subscription subject to prior termination in accordance with Clause 1.5 of these Terms.

1.4 For the avoidance of any doubt, the Weekly Report is for the sole use of the Subscriber, unless express permission is otherwise granted in writing by CMTL.

1.5 Any Subscription to access Weekly Reports which has been accepted by CMTL is subject to your continued compliance with, these (i) Terms, (ii) any express permissions agreed with CMTL, (iii) any and all applicable law, and (iv) the directions of CMTL with respect to the use of such Weekly Reports, CMTL reserves the right to terminate your Subscription or permission to access Weekly Reports with immediate effect, without refund, in the event of a breach of any of the foregoing.

1.6 To the fullest extent permitted by law, CMTL:

1.6.1 expressly excludes any guarantee, warranty, condition, term, representation or undertaking of any kind, express or implied, statutory or otherwise, relating to Weekly Reports or any other data provided under or in connection with these Terms, including the condition, satisfactory quality, performance, merchantability or fitness for purpose of Weekly Reports at any time;

1.6.2 makes no guarantee, warranty, representation or undertaking, express or implied, as to the originality, accuracy, correctness, timeliness or completeness of any of the information stated in the Weekly Reports;

 

1.6.3 does not guarantee the uninterrupted or un-delayed access to or availability of the Weekly Reports and shall not be liable to the Subscriber for any loss or expense howsoever incurred as a result of any interruption to the supply of Weekly Reports;

1.6.4 makes no guarantee, warranty, representation or undertaking, express or implied, as to results obtained or to be obtained by any person from the use or interpretation of Weekly Reports;

1.6.5 makes no guarantee, warranty, representation or undertaking, express or implied, that the Weekly Reports accurately reflects past, present, or future market activity.

2. Access and Rights

2.1 Access to Weekly Reports is obtained via a Subscription basis from CMTL. The Subscription and Subscribers respective rights and conditions, are set out below.

(i) A Subscriber who is granted access shall be entitled to the following:

(a) access to the current Weekly Report from the time of availability; and

(b) access to Weekly Reports published prior to the time of availability to the latest Weekly Report

(ii) A Subscription does NOT grant rights to, and a Subscriber shall NOT:

(a) pass Weekly Reports or any parts of Weekly Reports on to any third parties whatsoever, including, but not limited to, individuals, companies, news agencies, journalists, publications and research organisations;

 

And shall not without express prior written permission;

(a) display Weekly Reports, or any part or extract thereof, on any intranet or public website;

(b) reproduce or store in any other website or included in any public or private electronic retrieval system or service.

3. Law & Jurisdiction

3.1 This legal notice shall be governed by and construed in accordance with English law. Disputes arising in connection with this legal notice shall be subject to the exclusive jurisdiction of the English courts.
